Terms of use

The short version

Use Perch to glance at and manage the Apple Reminders you already keep. Don’t misuse it. Perch is a one-time Mac App Store purchase, billed by Apple in your local currency. We can update or discontinue the app, but we’ll try not to do anything that harms you.

1. Acceptance

By downloading, installing, or using Perch (“the app”), you agree to these Terms of Use (“Terms”) between you and so & so s. r. o. (“we,” “us,” “our”). If you do not agree, please don’t use the app.

Perch is distributed through the Mac App Store. Apple’s Standard End User License Agreement applies in addition to these Terms. You can review it at apple.com/legal/internet-services/itunes/dev/stdeula/. For matters governed by that EULA (such as App Store distribution and billing), it controls where there is any conflict.

2. The service

Perch is a menu-bar companion for Apple Reminders on macOS. It reads and writes reminders on your Mac through Apple’s EventKit frameworks. It has no account system and no server backend of its own. Sync across your devices, when enabled, is Apple’s iCloud Reminders under Apple’s iCloud terms.

Perch is intended for personal use. It is not a medical, legal, or financial tool and should not be relied on for decisions in those areas.

Requirements: macOS 26 or later, and permission to access Reminders when prompted.

3. License grant

Subject to your compliance with these Terms, so & so grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Perch on Apple-branded Mac computers you own or control, for your personal use only. This license does not transfer any ownership of Perch to you.

Your use of Perch is also subject to Apple’s Standard End User License Agreement, which is incorporated by reference into these Terms.

4. Purchases

Perch is sold on the Mac App Store as a one-time purchase. It is not a subscription and does not auto-renew.

Price

The price is shown in your local currency on the App Store and may vary by region. The price shown at the moment of purchase is the price that will be charged.

Billing

Apple handles payment and billing through your Apple Account. so & so never sees payment cards, billing addresses, or your Apple Account name as part of that process. Your Apple Account is charged at confirmation of purchase.

Family Sharing

Where Apple enables Family Sharing for Perch, other members of your Family group may use the purchase on their own devices under Apple’s Family Sharing terms. Apple owns that relationship; so & so does not manage Family Sharing separately.

Refunds

Refunds for App Store purchases are handled by Apple.

To request a refund:

  1. Go to reportaproblem.apple.com.
  2. Sign in with your Apple Account.
  3. Find the Perch purchase and submit your request.

so & so has no authority to issue refunds on Apple’s behalf. Where mandatory consumer law (for example in the European Union) gives you a stronger right to a refund, that right is not affected by these Terms.

Price changes

We may change the App Store price of Perch for future buyers. A price change does not affect a purchase you have already completed.

5. Acceptable use

You may use Perch for any lawful personal purpose. You may not:

  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent applicable law expressly permits.
  • Sublicense, rent, lease, or sell the app.
  • Use Perch to access or modify reminders you do not have permission to use.
  • Use the app in any way that breaks applicable law or another person’s rights.

6. Intellectual property

“Perch”, the Perch wordmark, the Perch app icon, and related visual assets, copy, design, and code are the property of so & so. These Terms grant you a license to use the app; they do not transfer ownership.

SF Symbols and other Apple-supplied assets used inside Perch are provided by Apple under Apple’s licenses and remain Apple’s property.

7. Disclaimers

The app is provided “as is” and “as available.” To the maximum extent permitted by law, so & so makes no warranties (express, implied, statutory, or otherwise), including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Perch depends on Apple’s Reminders and EventKit. We don’t warrant that every reminder will appear or update correctly if macOS, EventKit, or iCloud behaves unexpectedly. We don’t warrant uninterrupted or error-free operation, or compatibility with every future macOS or Reminders change.

8. Limitation of liability

To the maximum extent permitted by law, so & so shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or relating to your use of the app, even if we have been advised of the possibility of such damages.

so & so’s total cumulative liability arising out of or relating to these Terms or the app shall not exceed the total fees you paid to Apple for Perch in the 12 months preceding the event giving rise to the liability.

Nothing in these Terms limits any liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or liability for fraud or fraudulent misrepresentation.

9. Termination

You can stop using Perch and delete the app from your Mac at any time. We may suspend or terminate your access to Perch if you materially violate these Terms. Where reasonable, we will provide notice before doing so.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page. Continued use of Perch after an update constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the Slovak Republic, without regard to its conflict-of-law principles. The courts of the Slovak Republic have jurisdiction over any dispute arising out of or relating to these Terms, subject to any mandatory rights you have as a consumer in your country of residence.

If you are a consumer in the European Union, you may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Before any formal proceedings, we’d appreciate the chance to resolve any issue directly. Email perch@madebysoandso.com.
